By using this INFORMATION KIOSK (“Kiosk”), you understand and agree that all the information and data conveyed to you is provided on an “as is” and “with all faults” basis. The City of Philadelphia Division of Aviation (“City”), the owner and operator of the Philadelphia International Airport (“PHL”), makes, and you receive, no express or implied warranty or representation with respect to the information or data on this Kiosk (“Kiosk Data”), including that it is accurate, complete, or current; or that it will meet your needs or expectations.

You may not access or use, or attempt to access or use, the Kiosk to take any action that could harm the City or a third party. You agree not to provide material and misleading information knowingly and with intent to defraud. You may not use the Kiosk in violation of any applicable laws or in violation of the City’s or any third party’s intellectual property or other proprietary or legal rights. You shall not upload to or distribute or otherwise publish on to the Kiosk any malware, viruses, spyware, or other malicious software or files to the Kiosk. You further agree that you shall not attempt (or encourage or support anyone else's attempt) to circumvent, reverse engineer, decrypt, or otherwise alter or interfere with the Kiosk, or any content thereof, or make any unauthorized use thereof. In no event shall any communication made through the Kiosk constitute legal or other notice to the City or any of the City's agencies, or to any of the officers, employees, agents, or representatives of the City.

By using this Kiosk, you acknowledge and agree that you assume the entire risk of any loss to yourself or to others resulting from your use of or reliance on the Kiosk Data. No warranty shall be created from the Kiosk Data. In no event shall the City be liable to you or to any other party for any damages, claim or loss (collectively, “damages”) incurred or caused by you, irrespective of whether City has been informed of, knew of, or should have known of the likelihood of such damages. This disclaimer of liability applies to all causes of action. If the limited warranty and/or disclaimer of liability shall for any reason whatsoever be held unenforceable or inapplicable, you agree that the City’s liability shall not exceed one hundred dollars ($100).

These Terms of Use shall be construed and enforced in accordance with the laws of the Commonwealth of Pennsylvania. Any action related to these Terms of Use shall be brought in the federal or state courts located in Philadelphia, Pennsylvania.
